I'm afraid you're backed into a legal corner. Here is what I'd do, but I'm not a lawyer and you need to check with one if you want to be safe.
I'd publish a short ad in the public notice column in your local paper, stating "To whom it may concern: Be it know that the TV (make-model-serial), which was dropped off by an individual on (date) at (your address) for repairs, shall be considered abandoned and will be disposed of as of (30 days from the date you publish)". That should protect you. If you don't make some sort of reasonable, legal effort to find the owner, they could show up in 6 months and sue for today's retail price of an equivalent set. Also you should document what you do with the TV (Photo of it and date you throw it away, or donate it to charity and get a receipt). Been there, done that!!!! I don't ever accept any equipment from strangers without a signed repair tag, on which they have signed that they are abandoning the TV and hold no claim to it after (x) days, and that they acknowledge that they will owe ($___) if they decline repairs after I have put time into it. UPDATE: I left another message threatening to sell the TV in a week if not picked up (I wouldn't have; but, she don't have to know that). She called back, claiming that "she forgot I had the TV and that they would pick it up tomorrow between 2-3 PM". I guess we'll see. She also claimed that she needed to return the TV that she bought from me for repair because it was turning off by itself. It's one of those later model 32" RCA's that uses the ATC013, IIRC, chassis. I hope it's just defective front panel switches so I can simply replace them, tell them "no charge", and take your TV!

Perhaps if you have to call her again you should ask for a mailing address so you can send that registered/return receipt letter.

UPDATE #2: The dang TV is gone, outta here, good-bye! They actually showed up and picked it up. Now, I can sleep a little easier tonight!

No, it was raining so they said they would bring the RCA over later. Frankly, I hope they forget it's broke just like they forgot that the other TV was over here. |
